Cruelty against Leniency: The Case of Imperial Zoroastrian Criminal Law

The article examines the impact of Zoroastrianism on criminal law and legal theory during reign Sasanian dynasty (224–651 C.E) in late Antique Persia. This was historic period when also ideology Iranian state, which granted Zoroastrian church extraordinary power influence, a unique situation is termed by author as ‘imperial Zoroastrianism’. first part paper how imperial evolved from previous understanding religion law. second scrutinises wrong light eschatology cosmology, ethical principles that follow this very particular world view. Next, an individual section devoted to Zoroastrianism, regards punishment not but means save soul offender sufferings Hell. With such underlying principle mind, text looks for examples cruelty leniency substantive procedure. main body contemporary sources apocalyptic works. Finally, comparison Hindu Islamic follows description law, highlighting astonishing similarities. Considering results both analytic comparative methods, comes conclusion it itself suppresses crimes, rather their cosmology: religions are based divine justice less lenient toward crimes offenders than alternative concepts like grace or non-violence operative.
